New York City Mayor Michael R. Bloomberg vowed to appeal a city judge\u2019s dismissal of an \u201carbitrary and capricious\u201d ban on large sugary drinks.<\/p>\n

The ban on the sale of sugary drinks exceeding 16 ounces was set to take effect Tuesday, before New York Supreme Court Judge Milton A. Tingling Jr. decided Monday the city is \u201cenjoined and permanently restrained from implementing or enforcing the new regulations.\u201d<\/p>\n

Michael A. Cardozo, the Bloomberg administration\u2019s chief counsel, said in a statement that they plan to appeal the decision as soon as possible, because \u201cthe Board of Health has the legal authority \u2014 and responsibility \u2014 to tackle\u201d obesity.<\/p>\n

\u201cWe plan to appeal the sugary drinks decision as soon as possible, and we are confident the measure will ultimately be upheld,\u201d the mayor\u2019s office tweeted shortly after the decision was announced.<\/p>\n

In his 36-page ruling, Judge Tingling wrote that the rules are \u201cfraught with arbitrary and capricious consequences.\u201d<\/p>\n

\u201cThe simple reading of the rule leads to the earlier acknowledged uneven enforcement even within a particular city block, much less the city as a whole. \u2026 the loopholes in this rule effectively defeat the state purpose of the rule,\u201d he wrote.<\/p>\n","protected":false},"excerpt":{"rendered":"
