No Asian or Pacific American <\/strong>has ever served in any of the Justice Department\u2019s top four slots \u2014 Attorney General, Deputy Attorney General, Associate Attorney General or Solicitor General<\/strong> \u2014 but if Kagan is confirmed, odds are good that will change.<\/p>\n

Three of the four candidates often mentioned as Kagan\u2019s possible replacement as Solicitor General\u2013 Preeta Bansal, Neal Katyal and Sri Srinivasan<\/strong> \u2014 are Asian Americans, and all have been involved with NAPABA (National Asian Pacific American Bar Association).<\/p>\n

\u201cThis is an exciting time for us,\u201d said John Yang, who co-chairs the NAPABA\u2019s judiciary committee. \u201dThis obviously would be at the highest level any Asian American has ever attained in the Justice Department<\/strong>.\u201d<\/p>\n

Katyal<\/strong>, acting Solicitor General (who had been Principal Deputy Solicitor General since the start of the administration), and Donald Verrilli Jr., senior counsel to President Barack Obama, are thought to be the top contenders for the post, though no decision has been made.<\/p>\n

While they hold no Senate-confirmed positions in the Justice Department\u2019s Washington headquarters, Asian Pacific Americans<\/strong> are represented in the field by U.S. Attorneys Preet Bharara in New York\u2019s Southern District, Florence Nakakuni in Hawaii and Alicia G. Limtiaco in Guam and the Northern Mariana Islands.<\/p>\n

The NAPABA<\/strong> has been more active in judicial nominations than executive nominations, but both are stepping stones \u2014 if not exactly prerequisites \u2013 to fulfilling the group\u2019s highest ambition. \u201dThere are obviously implications for a future Asian Pacific American Supreme Court justice, which we hope is very close in the coming,\u201d Yang said.<\/p>\n
